General Terms and Conditions
1. Introductory Provisions
These General Terms and Conditions ("GTC") outline the rights and responsibilities of the seller and the customer arising from their contractual relationship established through the online store at www.lenartika.com ("online store").
The seller and operator of the online store is Lentimax Sp. z o.o. headquartered at Tymienieckiego 22L, 90-349 Lodz, Poland. VAT: PL7282810729, KRS: 000635486
Contact e-mail: info@lenartika.com
All contractual obligations are fulfilled at Tymienieckiego 22L, 90-349 Lodz, Poland.
The contractual relationships are governed by Polish law.
2. Definitions of Terms
The customer may be a consumer or an entrepreneur.
A consumer is any individual entering into a contract with the seller outside the scope of their business activities or independent professional work.
An entrepreneur is any individual or entity concluding contracts in connection with their business, manufacturing, or similar activities, including independent professions. If the customer includes a business ID in the order, the rules for entrepreneurs apply to them.
3. Formation of the Purchase Contract
The product listings in the online store serve as informational material. The seller is not obligated to conclude a purchase agreement based on the displayed goods.
Submitting a completed order via the online store (or by email) constitutes a binding offer to enter into a purchase agreement with the seller. Upon receipt of the order, the seller will confirm this via e-mail ("Order Information"). However, this confirmation does not represent acceptance of the purchase agreement. The purchase agreement is considered concluded only after the seller explicitly accepts the proposal, confirmed via email ("Order Confirmation").
The customer may cancel their order or withdraw their proposal for concluding the purchase agreement without penalties until the seller provides the Order Confirmation. Cancellations must be communicated by email. Changes to the order can only be made before the purchase agreement is accepted.
By submitting the order, the customer confirms they have reviewed and agree to these GTC, including the Shipment and Returns Policy, Privacy Policy, and Payment Terms, as effective at the time of order submission.
4. Consumer’s Right of Withdrawal
The consumer has the right to withdraw from the purchase contract within 14 days without providing a reason. This period begins upon receipt of the goods.
To exercise this right, the consumer must notify the seller by email: info@lenartika.com
For the withdrawal deadline, it suffices to send the withdrawal notice before the 14-day period ends. Refunds, including delivery costs (subject to exceptions), will be processed within 14 days of receiving the withdrawal notice and upon return of the goods.
Goods must be returned to the seller’s address, and the consumer bears the cost of return shipping.
Refunds will be made using the same payment method unless otherwise agreed, with no additional cost to the consumer.
Exceptions to Withdrawal Rights: Consumers cannot withdraw from contracts:
-
For custom-made items (e.g., personalized prints or framing);
-
The product must be in its original condition, and the mounting system must remain unused.
5. Withdrawal for Non-Consumers
Entrepreneurs cannot withdraw from the purchase agreement.
6. Shipping
Shipping options, conditions, and costs are detailed on the "Shipment and returns" page. Customers must inspect their package upon delivery for completeness or damage and document any discrepancies with the carrier. Damage or incompleteness claims after delivery do not affect the right to file complaints but allow the seller to verify compliance with the contract.
7. Payment Terms
Payment methods and terms are described on the "Payment and Delivery" page. Ownership of goods transfers to the customer upon full payment, but the risk of damage transfers upon delivery. Refunds for cancelled orders or returns will be processed using the same payment method.
8. Liability for Defective Performance
The seller ensures goods are free from defects upon delivery. The colour design of photographs and images on the customer's monitor may differ from the resulting inks on the delivered goods. Therefore, the colour deviation of the colour shade is not a defect of the goods.
9. Quality Guarantee and Complaints
Consumers can claim defects within 24 months of delivery; entrepreneurs within six months. Claims may be filed by mail at:
Lentimax Sp. Z o.o.
Tymienieckiego 22L
90-349 Lodz

Complaints are resolved promptly, typically within 30 days.
10. Pricing and Discounts
Prices include VAT. Discounts have specific terms and are not cumulative unless explicitly stated.
11. Data Protection
Customer data is processed per applicable privacy laws. See the Privacy Policy for details.
12. Final Provisions
All disputes will be resolved under Polish law by Poland courts. The contract is concluded in Poland, with translations serving informational purposes only.
These GTC are valid from January 1, 2025.
